Colombo District Court issues enjoining order against illegal SLR constitution move by “Working Task Force”

The Colombo District Court yesterday issued two enjoining orders against the Working Task Force of Sri Lanka Rugby and the Executive Director of Sri Lanka Rugby, restraining them from acting upon the draft constitution of Sri Lanka Rugby and from taking any steps based on such draft constitution.

The Western Province Rugby Football Union (WPRFU) President Roshan Deen and Secretary Waruna De Silva instituted action against Sri Lanka Rugby, the Executive Director of Sri Lanka Rugby, and the Working Task Force comprising M.R. Lathif, Suresh Subramaniyam, Dinal Philips, M.H. Marso, and Ravindranath Wijenathan. The defendants were attempting to take several steps under a constitution that remains in draft form and has not yet been adopted by Sri Lanka Rugby, which is an independent organisation governed by its own constitution.

The Working Task Force—whose appointment has also been challenged in a separate writ application before the Court of Appeal—was taking steps to call for applications from clubs and unions for recognition as members of Sri Lanka Rugby under the purported constitution, which has not been adopted at a Special General Meeting or Annual General Meeting held in accordance with the constitution currently in force.

President’s Counsel Jagath Wickramanayake, with Attorney-at-Law Supun Dissanayake on the instructions of Ramzi Bacha Associates, Attorneys-at-Law, submitted to court that in terms of the Sports Law Act No. 25 of 1973, the subject Minister has recognised the existing Sri Lanka Rugby Union as the association representing the national sport of rugby in Sri Lanka and Sports Law does not give any authority appointed to act in the interim to violate the constitution of Sri Lanka Rugby when its registration is temporary suspended.

Having considered the plaint, the documents annexed, and the submissions made on behalf of the WPRFU, the learned District Judge Sadun Vithana issued the following enjoining orders operative until 5 August and also issued interim injunction notices and summons on the Defendants.
