SC refuses Leave to Proceed on FR petition by ex-Vice Chancellor against ex-Minister

The Supreme Court refused to grant Leave to Proceed to the Fundamental Rights petition filed by former Sabaragamuwa University Vice Chancellor Prof. Chandana Premakumara against the erstwhile Higher Education Minister Dr. Wijeyadasa Rajapakshe.

The Bench comprised Chief Justice Jayantha Jayasuriya, Justices P. Padman Surasena and Gamini Amarasekara.

Petitioner Prof. Chandana Premakumara filed this Fundamental Rights petition complaining that the Respondent ex-Minister had come to a purported decision, by exceeding his powers, that the Petitioner had suppressed the evidence of an alleged ragging incident, without studying the incident and the documentation, and unlawfully interfered with the functions of the National Police Commission using his powers.

He pleaded he was involved in politics as an SLFP member, and the Respondent ex-Minister was then a member of the United National Alliance and wanted to discriminate against him due to his political opinion.

He stated that on or around the year 2014, there was an incident in the university where a female student made a complaint that she was victimised by a ragging incident.
