Petitioner seeks Karuna’s arrest over claims he killed 1000s of soldiers

A member of the Kaduwela Municipal Council filed a Fundamental Rights petition in the Supreme Court yesterday, seeking an Order from the Court for the arrest of the LTTE’s former Eastern Province leader Vinyagamoorthy Muralitharan, alias Karuna Amman, over his statement that he was responsible for the death of thousands of soldiers.

The Petitioner, Boseth Kalahe Pathirana, who is also a tuition master, in his Petition sought a directive from the Court to the Acting IGP to arrest Muralitharan over his statement, made at a public rally in Digamadulla, where he claimed he is more dangerous than the coronavirus, which has only killed 11 people so far, while he has killed 2,000-3,000 soldiers at Elephant Pass during the war.

The Petitioner says the former LTTE cadre turned politician can be charged under Section 293 and 294 of the Penal Code, the Prevention of Terrorism Act (PTA), the International Covenant on Civil and Political Rights (ICCPR) Act and 17 (a) of the Evidence Ordinance, as he has admitted to a crime which can be considered as a confessionary statement.

The Petitioner also noted that a former MP Ven. Omalpe Sobitha has also lodged a complaint against Muralitharan with the Police, and sought Court intervention to apply the law against Muralitharan.
