The Bar Association of Sri Lanka (BASL) has expressed grave concern over the death of a 29-year-old suspect in the custody of the Homagama Police, calling for an immediate, impartial and transparent investigation.

In a statement, the BASL identified the deceased as Ishara Harshakumara, a father of two from Kiriwaththuduwa, who had been arrested in connection with a drug-related investigation.

Family members who visited the Homagama Police Station on 25 October, 2026 reported observing physical injuries on the suspect, which they believed indicated that he had been severely assaulted, the BASL said. The Police Spokesman, however, gave a different account, stating that the suspect had developed a sudden illness during an operation and died following admission to hospital.

Citing these conflicting accounts, the BASL stressed the need for a credible and independent investigation to establish the circumstances of the death. It said the State has a fundamental responsibility to protect the lives, health and physical safety of individuals in police custody, and that any allegation of custodial violence or ill-treatment must be treated seriously. If wrongdoing is established, those responsible must be held accountable under the law, it added.

The Homagama Magistrate’s Court has ordered a post-mortem examination, and a preliminary inquiry has commenced under the direction of the Homagama Assistant Superintendent of Police, the BASL noted. It called on the Inspector General of Police (IGP) and relevant authorities to ensure that all evidence is properly preserved and examined, and that investigations are conducted without interference or prejudice.

The BASL said it would consider further action if necessary and keep its members and the public informed of developments.
