Every year, vast stretches of fertile land quietly slip into decline—not through sudden catastrophe, but through a slow tightening of ecological pressure. Soil loses its structure. Rivers shrink into seasonal memories. Agricultural productivity weakens. Communities that once depended on predictable rainfall patterns find themselves negotiating with uncertainty.

Global Desertification and Drought Day is often marked as an environmental observance. In reality, it is a legal and civilisational warning signal. Desertification is not simply the spread of deserts. It is the degradation of land in arid, semi-arid and dry sub-humid areas caused by climatic variations and human activity. Drought, meanwhile, is its accelerant and companion crisis—an intensifying hydrological stress that exposes the fragility of land-use systems built on climatic assumptions that no longer hold.

What is emerging is not just an environmental problem, but a governance failure across borders, sectors and legal systems. In this context, the idea of One Planet Law is no longer theoretical. It is becoming structurally necessary.

 

The global land emergency: Beyond environmental language

Across continents, land degradation is accelerating. According to global scientific assessments, nearly a quarter of the world’s land is already degraded. The implications are profound: reduced food security, increased forced migration, biodiversity collapse, and heightened socio-political instability. But the core issue is not only ecological. It is juridical.

Land degradation persists because legal systems treat land as:

  • a commodity rather than a living system, 
  • a national resource rather than a planetary asset, 
  • and an economic input rather than a climate stabiliser. 

This fragmentation produces governance blind spots. Agricultural policy, water regulation, forestry law, urban planning, and climate commitments often operate in isolation. Desertification slips through the cracks between ministries, treaties, and jurisdictions. The result is a structural mismatch between planetary reality and legal architecture.

 

Drought as a legal stress test

Drought is often framed as a natural disaster. Increasingly, it behaves like a stress test for governance systems.

When drought intensifies, it exposes:

  • weak water allocation regimes, 
  • inequitable land tenure systems, 
  • fragmented climate adaptation frameworks, 
  • and inadequate cross-border water governance. 

In Sri Lanka and many parts of the Global South, drought impacts rural agriculture most severely, particularly smallholder farmers dependent on rainfall-fed cultivation systems. Reservoir-based irrigation systems and cascade tanks, historically resilient, are now under pressure from shifting rainfall patterns and watershed degradation.

Yet legal responses are frequently reactive and crisis-oriented, emphasising emergency relief rather than structural reform and proactive approaches to ecological governance. A drought is not only a meteorological event. It is a legal audit of how society governs land and water.

 

Desertification and the collapse of legal silos

One of the most significant challenges in addressing land degradation is the siloed nature of environmental law itself.

Typically, legal regimes are divided into:

  • climate change law, 
  • biodiversity law, 
  • water law, 
  • agricultural law, 
  • land use planning law. 

Desertification sits at the intersection of all of them, yet is fully owned by none. This fragmentation is not accidental. It reflects a deeper epistemological structure in modern law: the assumption that environmental systems can be governed in discrete parts.

However, land does not function in compartments. Soil moisture interacts with atmospheric systems. Forest cover influences rainfall. Agricultural practices alter carbon cycles. Water extraction reshapes ecosystems. This is why emerging legal theory increasingly argues for integrated frameworks such as Carbon Law, Blue Planet Law, and ultimately One Planet Law.

 

Carbon Law: Time-bound legal constraint on emissions

The idea of Carbon Law introduces a temporal discipline into climate governance: emissions must halve every decade to remain within safe planetary boundaries. In the context of desertification, Carbon Law matters because climate change intensifies aridity. Rising temperatures increase evaporation rates, disrupt monsoon systems, and alter soil moisture retention. Without legally binding decarbonisation pathways, land degradation becomes structurally irreversible.  Carbon Law, therefore, is not only about emissions. It is about preserving the climatic stability required for land systems to function.

 

Blue Planet Law: Governing earth’s hydrological integrity

Where Carbon Law focuses on atmospheric stability, Blue Planet Law extends legal reasoning to the hydrosphere—the oceans, rivers, groundwater systems, and the global water cycle.

Desertification is fundamentally a water crisis expressed through land. Reduced rainfall, groundwater depletion, and disrupted river systems are hydrological manifestations of broader planetary imbalance.

Blue Planet Law reframes water not as a national resource alone, but as part of a planetary commons requiring coordinated legal stewardship.

For drought-prone regions, this shift is critical. It demands:

  • transboundary water governance, 
  • protection of catchment ecosystems, 
  • regulation of groundwater extraction, 
  • and restoration of natural water cycles. 

Without such integration, drought management remains reactive rather than preventative.

 

One Planet Law: A unified legal consciousness

One Planet Law emerges as a synthesis of these frameworks. It is not a single statute or treaty, but a governing logic: the recognition that Earth’s systems are legally indivisible.

Under One Planet Law, land, water, carbon, and biodiversity are not separate policy domains but interconnected legal subjects.

This approach implies several foundational shifts:

1. Planetary interdependence as legal fact

Environmental harm is assessed not only locally but through cumulative global impact. 

2. Ecological systems as legal entities of concern

Soil, watersheds, and ecosystems are treated as active components of governance frameworks. 

3. Cross-sectoral legal integration

Climate, agriculture, water, and land law are harmonised rather than fragmented. 

4. Preventive rather than reactive governance

Legal systems focus on avoiding ecological tipping points rather than responding to collapse. 

In the context of desertification, One Planet Law reframes land degradation as a violation of planetary stability, not merely a local land-use issue.

 

Sri Lanka’s position: A microcosm of planetary stress

Sri Lanka offers a particularly instructive case. The country’s historical hydraulic civilisation—centred on tank cascade systems—was an early form of integrated land-water governance. These systems reflected an intuitive understanding of ecological interdependence. However, modern pressures have disrupted this balance:

  • shifting rainfall patterns linked to climate change, 
  • deforestation in upper catchments, 
  • urban expansion into agricultural zones, 
  • and fragmented water governance structures. 

Dry zone districts increasingly experience recurrent drought cycles affecting paddy cultivation, drinking water access, and rural livelihoods. From a One Planet Law perspective, Sri Lanka is not only managing a national drought issue. It is navigating a planetary governance challenge at a local scale. This creates both vulnerability and opportunity: vulnerability because global systems drive local impacts; opportunity because local legal innovation can model integrated solutions.

 

Law as climate infrastructure

One of the most important conceptual shifts in contemporary environmental governance is the recognition that law itself is infrastructure.

Just as dams regulate water and carbon markets regulate emissions, legal systems regulate ecological behaviour. In the context of desertification, legal infrastructure determines:

  • how land is used, 
  • how water is allocated, 
  • how forests are protected, 
  • and how agriculture adapts. 

Weak legal infrastructure produces ecological collapse even in the presence of technical knowledge. Strong legal infrastructure can stabilise ecosystems even under climatic stress. Thus, the central question becomes not only what policies exist, but whether legal systems are capable of planetary coordination.

 

From crisis response to planetary stewardship

The dominant global approach to drought and desertification remains crisis-oriented: emergency food aid, short-term water distribution, and reactive agricultural support. While necessary, these measures do not address structural drivers. A One Planet Law approach demands a shift toward stewardship:

  • restoring degraded land as a legal obligation, 
  • integrating climate projections into land-use planning, 
  • enforcing watershed protection regimes, 
  • and aligning agricultural policy with ecological thresholds. 

This is not environmental idealism. It is systems necessity. Desertification is often described as a slow catastrophe. But it is more accurately understood as a legal outcome of cumulative decisions. Every deforested watershed, every over-extracted aquifer, every fragmented policy framework contributes to a larger pattern of ecological decline. Global Desertification and Drought Day should therefore not function as symbolic commemoration alone. It should operate as a jurisprudential reminder: that land degradation is governed by law, and can therefore be re-governed by law.

The emergence of Carbon Law, Blue Planet Law, and One Planet Law signals a shift in legal imagination—from managing environmental damage to designing planetary stability. The central challenge of the coming decades is not whether we understand desertification. It is whether our legal systems are capable of preventing it. Because ultimately, the question is no longer how much land is being lost. It is whether law itself can still keep the planet habitable.
