Taprobane Marketing restrained from using trade name ‘Globe’

The Commercial High Court of Colombo issued an enjoining order restraining Taprobane Marketing (Pvt) Ltd. from importing, marketing and selling padlocks with the name ‘Globe’ or any similar or identical padlock as it violates intellectual property rights of Tradesmann SL (Pvt) Ltd. in case number HC (CIVIL) 01/2012/IP.

Tradesmann, which is the plaintiff company, filed action in the Commercial High Court of Colombo seeking an interim order against Taprobane Marketing (Pvt) Ltd., for infringement of intellectual property rights for the popular padlock imported and marketed in Sri Lanka by the name ‘Globe’.

The Commercial High Court Judge of Colombo P.W.D.C. Jayatillake yesterday after hearing the submissions made by Attorney-at-Law Faiszer Musthapha, counsel appearing for the plaintiff, issued the said restraining order against the defendant Taprobane Marketing.

The counsel submitted to court that the defendant company, by importing marketing and selling a padlock which carries the trademark ‘Globe’ to which the plaintiff has exclusive rights, is a clear violation of the intellectual property rights of the plaintiff company.

The plaintiff was represented by Attorneys-at-Law Navodha Wijeratne, Tharaka Nanayakkara, Isuru Balapatabendi and Niluka Perera with Senior Counsel Attorney-at-Law Faiszer Musthapha.
