The Kandy Sports Club and Sri Lanka Rugby Football Union (SLRFU) have come to an agreement to withdraw the litigations filed in Court against each other.
The agreement arrived at by both parties now enables the rugby authorities to declare a winner for the last year’s inter-club league rugby tournament.
The terms of agreement are as follows:
a)The parties agree that in accordance with the total points tally in connection with the Caltex Inter Club “A” Division Rugby League Tournament 2011, the Kandy Sports Club has won the league, irrespective of the 6 points that are in dispute in this action;
b)ccordingly the Defendants agree and undertake to award the Championship Trophy of Caltex Inter Club “A” Division Rugby League Tournament 2011 to Kandy SC within two weeks;
c)The parties agree that in view of the foregoing adjustment, there is no need for a judicial determination on the cause of action pleaded in the Plaint and the claims in reconvention pleaded in the answer;
d)The parties accept this adjustment as a full and final settlement of the entire subject matter of this action without any party being entitled to costs.
Plaintiff Kandy SC filed an action against the Defendant SLRFU and obtained an injunction order in the District Court preventing the awarding of the cup to any other team in case, they did not finish the points table on top at the conclusion of the league tournalment.
SLRFU filed a case against Kandy SC stating that SLRFU would not award the cup to the Nittamwela club till Kandy SC withdrew the case against it.
