Capri Club President Morgan Fernando has sent the following statement in reference to the article published in the Daily FT newspaper on 17th March 2011 the heading “Capri Chief to hold AGM” (page 1 and continued on page 4).

It is with regret that I bring to your kind attention that the said article under reference does not reflect the correct position of the case and/or the events that took place in Court on 15th March 2011.

It is to be noted that there was no directive whatsoever by the Court on me to call and conduct the AGM of the Club as stated in your said article.

It was on an application made by the Counsel for the respondent Mr. C. Kundanmal to consider whether an overall settlement is possible that the case was adjourned for 29th March 2011.

Mr. Faizer Mustapha and Mr. Cassim appeared for Mr. C. Kundanmal while Mr. Kuvera de Zoysa and Mr. Shabri Halimdeen appeared for Mr. Morgan Fernando.
