The District Court of Colombo yesterday issued notice on the JVP leadership informing that the court will restrain them from holding the convention which is scheduled to be held at Tissamaharama on 1 January in the event if they ignored the court’s notice.
Colombo District Judge W.R.R.N Watupola issued this notice on the JVP Leader Somawansa Amarasinghe and on the Central Committee members on considering the submission made by Counsel Iraj De Silva who appeared with Nuwan Bopage instructed by Anusa Wickramasinghe and perusing the petition and the annexed documents on behalf of the two dissident members of the JVP namely Ajith Kumara and G. Kularatna.
The Counsel submitted that the petitioners are lawfully elected to the executive committee, are entitled to vote in the elections and that due to dissenting opinion with the leadership on certain issues, the leadership without informing them and without informing some members of the central committee had scheduled to hold a convention in order to elect members to the executive committee.
He said his client and the dissenting members are entitled to vote in an election and the JVP leadership without considering that matter illegally unlawfully and purposely had fixed to hold the convention at the Debarawewa play grounds at Tissamaharama.
The counsel also said that the leadership had unlawfully recruited 221 new members to the committee against the constitution of the party.
The Counsel contended that the leadership had planned the entire episode deliberately to prevent the dissident members from taking part in the party affairs.
He said he will not ask court to prevent JVP holding the unlawful convention but for a declaration that the convention is unlawful illegal and it is null and void.
District Judge Watupola issued notice of injunction on the JVP leadership in the event that if they attempted to hold the convention against the court’s notice they will be restrain from holding the meeting.
Court issued summons on the Central Committee members to appear in court on 6 January.
