The Colombo District Court yesterday restrained the incumbent monk of Abayarama Temple of Thimbirigasyaya Venerable Murutetuwe Ananda Thero from using the temple for political and trade union affairs until the adjudication of a civil suit filed by a monk claiming incumbentship to the temple.
District Judge S. Nissanka issued this restraining order upon considering the submission made by the counsel for the petitioner and perusing the documents annexed to the petition. The petitioner Venerable Pathberiye Wimalananda Thero by had claimed that the petitioner was the lawful successor to be the incumbent monk of the temple according to the Buddhist succession law.
The defendant monk however had unlawfully taken over the incumbentship of the temple and used the temple for political affairs and trade union matters.
The petitioner claims that these actions of the defendant had damaged the reputation and reverence the public had for the temple as a place of Buddhist worship.
Thus, the petitioner pleaded the Court to restrain the monk from using the temple for what he termed were dishonourable acts.
