Lawyers for impeached Chief Justice Shirani Bandaranayake yesterday filed a motion in Magistrate’s Court claiming that the notice issued on her by the Bribery Commission was erroneous.
Counsel for Bandaranayake, Nalin Ladduwahetty PC said the prosecution had failed to serve charges on the ousted Chief Justice and notice could not be served without completing that provision.
Ladduwahetty PC said that his client had received no charges signed by Colombo Chief Magistrate Gihan Pilapitiya naming her as an accused. Therefore notice could not be served on her either, her lawyer said.
Bandaranayake’s lawyers also requested Court to direct the prosecution to provide copies of any reports or other documents, computers and computer data which the prosecution intends to use as evidence.
The case has been fixed again for 14 November to consider the case further.
