Cabinet has approved a proposal by Justice, Human Rights and Law Reforms Minister Nimal Siripala De Silva, to enter into an agreement with the Czech Republic for the transfer of sentenced persons between the two countries. In terms of the provisions of the Transfer of Offenders Act, No. 5 of 1995, a citizen of another country convicted and sentenced to imprisonment by a Court in Sri Lanka can serve his/her sentence in the country of which he claims to be a citizen, and a citizen of Sri Lanka imprisoned in any other country can serve his/her balance period of imprisonment in Sri Lanka.
In order to make the provisions of the Act to be applicable, it is essential for an Agreement to be entered into between Sri Lanka and the respective country. Hence the proposal by the Minister to enter into an Agreement on transfer of sentenced persons between the two countries in conformity with the laws of both the countries was approved by the Cabinet.
