The Court of Appeal yesterday dismissed the Writ Petition filed by a member of the Kaduwela Municipal Council, seeking an Order for the arrest of former LTTE member Vinayagamoorthy Muralitharan, alias Karuna Amman.
The Petitioner, Boseth Kalahe Pathirana, who is also a tuition master, sought a Court directive to the Acting IGP, to arrest the former LTTE member over his statement made at a public rally in Digamadulla, where he claimed he is more dangerous than the coronavirus, which has only killed 11 people so far while he has killed 2,000-3,000 soldiers at Elephant Pass during the war.
The bench comprised CA President Justice A.H.M.D Nawaz and Justice Sobhitha Rajakaruna.
In dismissing the case, Justice Nawaz said that Police has already initiated an inquiry into the statement, but that there was nothing substantial that has been uncovered against Muralitharan to enable the case to be carried forward. He also referred to the request from the Election Commission to postpone inquiries against candidates until the conclusion of the upcoming General Election.
