Serene Pavillions contempt of court case: summons to be issued

When the application of contempt filed by M/S Paul Ratnayeke Associates on behalf of Anura Lokuhetty over the on-going dispute between shareholders of Serene Pavillions Waduwa was called on 06th of December 2013 for support at the Court of Appeal 303 before the Lordship Anil Gunarathne and the Ladyship Malini Gunarathne, Romesh de Silva (PC) together with N.R. Shivendran (AAL), Shanaka Cooray (AAL) and Manjuka Fernandopulle (AAL) instructed by M/S Paul Ratnayeke Associates appeared on behalf of you the petitioner (2nd respondent – petitioner) of the above matter. The matter was supported and the Court directed to issue summons to the petitioner – respondent (Sumith Guruge) and the 3rdrespondent – respondent (Jit Warnakulasooriya). The petitioner has listed the following as contempt of court on the part of the respondents: filing action bearing no HC (Civil)/42/13/CO in the High Court of the Western Province exercising civil jurisdiction holden in Colombo and applying for and obtaining ex parte interim orders preventing the Petitioner and his wife from functioning as directors of the 1st Respondent-Respondent company; writing to tour operators stating that a company called “Citrus Leisure PLC” would be exclusively responsible in promoting and marketing Serene Pavilions in future; entering in to the ‘Serene Pavilions’ hotel premises on 11th of October 2013 together with the CEO and employees of Citrus Leisure PLC to take over the management; contacting the resident manager of the Serene Pavilions hotel and informing him to take orders from Citrus Leisure PLC and not from the Petitioner and physically removing the Petitioner on the 11th of October 2013 in order to take over the management of the hotel. This matter will be called on 29th January 2014 for notice returnable.
