Abans files legal action against errant employee and obtains enjoining order

Abans Electricals PLC, a member of the Abans Group of companies, has filed legal action in the District Court of Colombo against Robol Lenorage Indika Sampath for breach of contract. Sampath was an employee of Abans Electricals PLC who has their registered office at No. 498, Galle Road, Colombo 3. He joined the company on 1 November 2010. The company selected him to undergo specialised training in Indonesia for six days from 13 to 18 January 2013. Before undergoing the training program in Indonesia he entered into a bond to serve the company for a minimum of two years on his return to Sri Lanka. The bond also specifically prevented him from seeking employment in a competitor company before the expiry of two years of his return to Sri Lanka after training in Indonesia. On his return after specialised training, Sampath was promoted and his remuneration was increased substantially. In spite of all the extended privileges afforded to him, he abandoned his post and has been working for Softlogic Holdings Ltd. from or about 18 August 2013 and has breached the terms of the bond with Abans Electricals PLC. Abans Electricals PLC has filed action in the District Court of Colombo DSP 218/13 and the court has issued an enjoining order against the ex-employee preventing him from working at Softlogic Holdings Ltd.
