Legal wrangle on recovery of EPF: CA fixes argument on 18 November

Court of Appeal on June 9 issued an Interim Order staying further proceeding at the Labour Tribunal/Additional Magistrate’s Court of Kandy until the final determination in respect of a Writ Petition filed by a Charitable Organisation against the EPF claim by its project coordinator.

The bench comprising of Justices A.H.M.D. Nawaz (President/CA) and Sobitha Rajakaruna on 8 July fixed for filing objection on or before 10 September and Counter Objection one month before the argument. Argument is fixed for 18 November.

Petitioner Foundation for Environment, Climate & Technology of Kandy cited the Commissioner of Labour, Kandy Assistant Commissioner of Labour, Project Coordinator Samsudeen Zeenas Yahiya and Additional Magistrate of Kandy Labour Tribunal as Respondents.

Petitioner claims it is a registered non-profit charitable organisation incorporated under and in terms of the Companies Act and later was re-registered under the Companies Act as a company limited by guarantee and was allowed to dispense with the word “Limited”.

Faisza Markar with M. Ratwatte appeared for the petitioner. Primal Rathwatte appeared for the 3rd Respondent.
