The Court of Appeal yesterday issued notice on The Cabinet of Ministers, Richard Pieris Tyre Company Ltd., 14 other suppliers, SLTB, and others, regarding the cancellation of a public tender called for in 2018 for procuring pre-cured and rebuilt tyres for the Sri Lanka Transport Board (SLTB).
The bench comprised Justices A.H.M.D. Nawaz and Sobhitha Rajakaruna.
Attorney-at-Law Dashinth Thabrew appeared for the Petitioner Tiran Tyre Ltd., instructed by Attorney-at-Law Tanya Thabrew, supporting an application seeking Writs of Certiorari and Mandamus in the Court Of Appeal in respect of an unreasonable, unlawful interference of the policy cycle that governed a public tender for the supplying of pre-cured and rebuilt tyres to the SLTB, which resulted in the arbitrary cancellation of the said Tender.Attorney Thabrew argued that the cancellation of the Tender resulted in ultimately defeating the sacred principle of administrative fairness.
The matter was fixed for 27 July for Notice Returnable.
