The directors of Blue Ocean Breeze Ltd. had strict bail conditions imposed on them, as well as having their passports impounded, by the Mount Lavinia Magistrate yesterday.

The two directors were accused of cheating and criminal breach of trust for a sum of money amounting to Rs. 275 million, after they failed to hand over an apartment to one Leon Rasiah, a purchaser.

Rasiah filed a Private Plaint before the Mount Lavinia Magistrates Court, detailing that the Thumilans, having taken full payment of the sum, failed to deliver vacant possession of the property.

The duo pleaded not guilty to the charges when they were read out. The complaint alleged that there were many instances in which the developers, in the guise of developing condominium properties, siphoned off the moneys of innocent purchasers.

The matter was fixed for 17 December 2020.

Faiszer Musthapha PC, Wasantha Nawarathna Bandara PC, Meheran Careem, Ameena Musthapha, and Ashan Nawarathna Bandara appeared for the Complainants.
